police the shooting does not appear random, and they are right now looking into a motive. the shooting happened at a gas station at about 5:30 p.m. at the intersection of calaroga avenue and west tennyson road. police say at least one person walked up to the victim who was sitting in a gold cadillac and fired several shots hitting the man in the head, chest and

shoulders. police say the victim is 25-year-old johntue caldwell of fremont. family and friends say caldwell was one of several friends with oscar grant when grant was shot and killed by a police officer new year's day. grant's uncle says he spent some time with his nephew's friend, talking with him a few weeks ago. he says caldwell was doing well and taking care of his two young sons. >> you know, much love to, you know, johntue's family. you know, especially to his mother. you know, being -- she stood up as being a play aunt to oscar, you know? and so in many ways i was a play uncle to johntue, spent much time with him. and you know, this is a sad day for all of us. >> caldwell was the god father to grant's daughter. police say there is no surveillance video from the gas station. they are relying on witnesses to

give them more information about what happened. police say they are still looking for the shooter and investigating whether caldwell was in fact the intended target. if you know anything about this shooting, you are asked to call hayward police. live in hayward, kimberly tere, nbc bay area news. >> thank you, kimberly. we are following some inveloping news outt now, ancisco right now, investigators are on the scene of an officer-involved shooting. the shooting happened near the intersection of oakdale and third street in the bay view district. it happened around 4:30 this afternoon and police have not released many details just yet, but we do know multiple shots were fired and at least one person was shot. again, this is an officer-involved shooting, and we will have more information on this as soon it's it becomes available. hundreds of people gathered in the south bay today to remember a santa cruz family killed in a plane crash earlier this month. the family died when their plane went down near watsonville

community hospital ten days ago. the family was apparently headed to yosemite national park. the four were remembered at today's memorial service as a close-knit adventurous family. the cause of the crash is still under investigation. the military's don't ask, don't tell policy is back, at least for now. late last night a federal appeals court in san francisco ordered the military to temporarily reinstate the controversial policy. the order came in response to a request from the obama administration that was worried the appeal was happening too fast. last night's ruling is the latest in a long legal tug of war, and today about 200 active and retired military men and men gathered for the gay pride celebration down in san diego. >> these folks are demonstrating that we fought for our country, we fought for your rights, and so we're here to show our own pride of our patriotism to our country and who we truly are without being concerned of getting fired. >> don't ask, don't tell was

reinstated with one major exception, though. the military cannot investigate, penalize anyone who was openly gay during the appeals process. a conservative group, the capital resource institute filed documents yesterday to start a voter referendum on the so-called fair education law. governor jerry brown signed the law on thursday, backers would have to collect more than 400,000 signatures to allow voters to decide whether to keep the law in place or reject it. the law requires all public schools to include lesbian, gay, bisexual and transgender history in social studies classes. opponents of the bill say lawmakers should not micromanage school curriculum. a small earthquake jolted some east bay residents awake early this morning. the 3.4 magnitude quake hit alameda county just before 4:00 this morning. it was centered south of

berkeley in oakland and three miles from emoriville. there are no reports of damage or injuries there. rupert murdoch made a public apology today in major newspapers across the uk a week after shutting down "news of the world." the latest on the phone hacking scandal. >> reporter: good day to you. it is frankly astonishing, this is the newspaper that first revealed the phone hacking scandal, a bit like "the washington post" during watergate, if you like. and inside is a full-page apology from rupert murdoch. he runs fox television, "the wall street journal," 20th century fox. yesterday the chief executive of dow jones had to resign because he worked here before moving there. now, of course all this began with revelations of wrong doing of journalists listening to people's cell phone voicemails, and this week reports of

in santa cruz today a church is closed after being vandalized. a piece of history was stolen from holy cross church. police spotted a man carrying a piece of wood near the church friday. they arrested him after he allegedly admitted to breaking the statue into pieces and stealing it from the chapel. the statue of st. joseph was made in 1791. it was from the original mission santa cruz. it is considered priceless, of course. church officials seiche the restoration, if at all possible, is going to cost thousands of dollars. 54-year-old lee wilson was booked in county jail for felony vandalism, grand theft, and probation violation. after almost 100 years in oakland, clorox could leave town. carl icahn owns 10% of the

today as people were warned of a so-called carmageddon and they're getting quite the opposite. traffic that normally clogs the highways even on weekends was sparse this weekend. it's exactly what the los angeles transportation leaders were hoping for and a welcome surprise for drivers. there's a bunch of construction going on which is why they were anticipating all of this. but business owners weren't quite as pleased today. >> this is great. it was the best. >> no traffic. >> no traffic. none. it took me ten minutes to get here. >> it scared off customers because nobody wants to travel, nobody wants to leave. >> crews are demolishing a bridge over one of the busiest frid freeways in the country. officials are still concerned about tomorrow, whether folks might get back on the road after seeing them empty today. speaking of travel, a new type of air ship is in the works. company officials say the first of its kind blimp could change the way military moves, the way goods are transported, and even get you off the road and into the air on vacations.

jane wells explains. >> reporter: what if the military could bring in more equipment than ever to remote battlefields? or walmart get tons of goods from china without using ships and trucks? or what if you could tour the country from the height of the eiffel tower? >> what we're trying to achieve is almost like going back in time. >> reporter: the ceo of aeros, the first ship a football field long is being built in an old hanger on a former marine base. nobody's ever done this before. >> nobody has done this before. >> reporter: most air ships have three problems. they need ballast. if you offload cargo, you better replace the weight with something. they have fabric skins, light but vulnerable. plus they need somewhere sturdy to land and a ground crew. this doesn't need ballast. it's controlled by engines powered with jet fuel. it has a rigid skin made out of

composite materials and can do verticle takeoff and landings. >> it is also capable of going much greater range and higher payload than a helicopter. >> reporter: for commercial purposes the hope is something like this could carry ton of construction materials to remote locations where there is no infrastructure, not even a runway. for $40 million apiece, who's interested? the military and construction companies. the aeros craft should be able to carry 60 tons of equipment to places without roads. >> you can build factory in africa. >> reporter: but as a tourism vehicle, won't a floating hotel face an image problem? namely memories of the hindenburg? >> if you turn to anyone and think, if you've got an opportunity right now to go on this, i'd be really surprised if anyone would be thinking of the hindenburg.

>> jane wells, cnbc. hard to say. the weather is starting to warm up maybe just a little bit. >> just by a couple degrees in a few spots today. we did see temperatures get close to 80 at least around the valley, 75 in santa cruz. that's not too bad but that was the exception to the rule. we saw 66 in san francisco and oakland, san jose, 75 degrees. but look at livermore. it's the tri valley, which typically 80s and 90s this time of year. only mid-70s around san ramon, heading up to fairfield. 72, pleasant evening in san jose, but once again tonight we'll see the low clouds filling into the south bay. 64 in oakland, a few sunny breaks but a lot of low clouds surging inland. you can see it blasting past the transamerica tower there. winds west at 16 and mists accompanying the low clouds this evening. temperatures much like we saw during the work week, quite below average this time of year, helped by a steady sea breeze

reaching all inland valleys, keeping temperatures down as we kick off the weekend. but we should start to see changes, perhaps you'll notice a few of those by the end of the weekend and especially towards the middle part of the new week. in terms of clouds, you can see them banked all along the coastline, up towards san francisco. golden gate bridge, very foggy drive. we did get the sun to break out, even monterey saw some sun. the reason why we're locked in this pattern, 80% of the country sees temperatures above 90 degrees, we have the opposite here. low clouds are locked in the coast. we will wrap up the weekend and head into monday with that strong sea breeze. temperatures may try to warm up a couple degrees tomorrow. but if you're looking for some real noticeable warming for inland valleys, tuesday and beyond, we will see 80s inland. the cooling trend will hang on

for another day or so, then things back to july-like numbers for the middle part of the new week. tonight, some areas of low clouds and drizzle, once again pretty familiar. we've been seeing it for about the last week or so. and for tomorrow morning, once again, a misty start or some light drizzle and a few areas, especially in the east bay hills. we'll see temperatures in the mid-70s around san jose. close to 80 around los gatos. 60s in the east bay valleys, mid to upper 70s and across the north bay, maybe a couple degrees warmer, but i think if you're going to find noticeable warming, we're planning tuesday, wednesday and beyond that finally looks more like july. because july typically is not one of the coolest months of the we'll right back. supposed r r

for the first time ever, safeway stores throughout much of the country launched a summer food drive. organizers say there's an increasing need for food for low income families in the summer months, particularly with children not getting food at

school. but they say it's also challenging to get people to think about giving this time of year. >> you've got the good stuff. >> this delivery of food from the league of volunteers food bank today is a god send according to patricia blackwell and her family in union city. >> i brought you vegetables from our garden. >> reporter: blackwell has five children and grandchildren living with her and says she's on disability after back surgery. >> well, it means i can eat. we will survive. we will not go hungry. and we will be able to bathe. brush our teeth. it's -- it's just thankful -- i'm thankful that somebody can help. >> reporter: this food all came from safe way's first-ever food drive. >> people think during the holidays they stock up the food pantries but they forget about the off holiday season and in the summer, a lot of these children are in the free lunch program. so during the summertime they're not getting that meal.

and it's a little bit harder, puts a little more strain on the household. >> thank you. >> reporter: safe way launched the program after hearing from the food banks asking for help, and safe way stepped up. the stores are asking customers to purchase a prefilled grocery bag for $10 each filled with tuna, peanut butter, cereal and more. >> one in five kids go hungry in the summer and there aren't those programs. >> reporter: patricia says she is grateful. >> how it help me? do you see all the kids i've got? you see the kids. they help me a lot. because they eat. >> we saw all the kids and they do eat a lot. all kids. the program at bay area bay safeway continues by the way through next sunday. a life line also came through this weekend for a camp that gives diabetic children a rare chance at a few nights away from mom and dad. earlier this week the dreams of sleep away camp were shut down for 150 children when the

nonprofit diabetes society abruptly shut its doors. now the ymca of silicon valley is saving the day. organizers hired the former camp director and are getting things in order so parents can reregister their children for the august camp at no aidditionl charge. it's really their only chance at a childhood tradition. >> it's something that can't be replaced in any other environment. it can really only happen at this place where they're away from their parents, they're among other kids with diabetes, it's very freeing and very empowering. and it only happens once a year. >> the $650 fee covers about a third of the actual cost. the rest is paid through donations and fundraising and now being paid partly by the ymca of silicon valley. right now, let's check in with jim with comcast sportsnet. what's going on in the sports world, jim? >> all right, diane. these are the stories we are working on here in our comcast
